Mills Policies
1. Claims for manufacturing defects will not be considered until merchandise has been inspected by one or more of the following: distributor/company representative, dealer and/or independent inspection service and a complaint form filled out and forwarded to claims department. All correspondence pertaining to claims will be handled through distributor or dealer and manufacturer.
2. Before any claim is filed against the manufacturer's warranty, it must be determined by the distributor/dealer that the consumer has complied with the conditions and terms of the particular warranty. Manufacturer will not consider any warranty claim until this has been determined.
3. Claims will not be considered for carpet sold to the dealer as second quality, irregular, mill end or at a substan- tial discount from list price.
4. No claims will be considered on carpet which has been installed with visible defects. Dealers are responsible for checking all merchandise for correct style, color, dye lot and any other visible defects before cutting and installing.
5. No claims will be considered by the manufacturer which arise as a result of improper installation or Maintenance. (See CRI 104 - Standard for Installation of Textile Floorcovering Materials and How to Specify Commercial Carpet Installation).
6. The claims liability shall in no case exceed the actual dealer cost of the carpet in a complaint. There will be no participation by manufacturer for labor expenses. This includes extra costs involved due to delivery delays, replacements or extra handling.
7. Claims will not be considered for sidematch of different dye lots. Color may differ slightly from dye lot to Dye lot. Because of manufacturing variances, sidematch of pattern carpet cannot be guaranteed; therefore Claims cannot be considered. Additional carpet yardage may be required for the installation of patterened carpet. No claims will be considered for slight color or texture variation between merchandise shipped to the dealer and his display samples. 8. Pile crushing, pile shading, watermarking, and soiling are not manufacturing defects and will not be con- sidered as a basis for claims. Claims for fuzzing and pilling will be subject to examination and testing by the manufacturer. Claims for missing tufts will not be considered except on a basis of repair. No claims will be honored for carpet installed on stairs, in elevators, and in bathrooms. The mill reserves the right to correct any repairable manufacturing defect. 9. Returned merchandise will be accepted only when authorized by the Claims Department. All returned mer- chandise is subject to mill inspection, and credit will be issued according to the validity of the complaint.
10. Installed carpet may be subject to a usage charge if replace.
11. Merchandise received in damage condition, either visible or concealed, constitutes carrier responsiblility and claims should be presented to carrier. Consignee has fifteen (15) days after receipt of goods to file claims for concealed damage. (See ICC Regulation and NMFC Rules-National Motor Freight Classification 100.)
12. Unauthorized deductions from remittances are subject to charge back, plus interest, factoring charges, and loss of terms on invoices involved.
13. No claims will be entertained unless presented to the company within one year of the invoice date unless covered by specific warranty.
14. The manufacturer reserves the right to charge a restocking fee plus freight to destination and return freight for any carpet returned except for a mill error or problem and/or as authorized by the mill.
15. Final disposition of all claims must be authorized by the manufacturer's Claims Department. Any adjustment made by anyone other than the manufacturer's Claims Department is not binding upon the manufacturer.
16. Dimensional width tolerances for cut rugs or rolls shall be consistent with GSA regulation DDD-C-0095 A: i.e. the width shall be within 1% of the dimension specified. Claims for narrow goods within these tolerances will not be considered.
17. CRI has adopted the Standard for installation of Textile Floor Covering Materials (CRI-104) as the minimum installation technique. Evidence that these recommended specifications were not adhered to would be a basis for disallowance of a claim against those carpet manufacturers who have chosen to adopt those standards.
18. Carpet is manufactured for use as a floorcovering. The installation of this product on other surfaces is not recommended. Carpet manufacturers cannot assume any liablility, real or implied, when the carpet is ap- plied on surfaces other than floors.
19. The use of after market topical treatments without the express approval of the carpet manufacturer prior to application will not be considered as a claim and may void other applicable warranties.
